Terms and Conditions for WorkoutMate

Welcome to WorkoutMate! These Terms of Service ("Terms") govern your access to and use of WorkoutMate's website, apps, and services (the "Service"). By using the Service, you agree to these Terms.

1. Our Services
WorkoutMate provides a privacy-first AI personal trainer that delivers real-time form analysis on your device, along with workout tracking, social/community features, and subscription plans (including Free and Pro) across web and mobile.

2. Eligibility and Health Commitments
You must be at least 13 (or the age of digital consent in your region) to use the Service, and if you are under 18 you must have a parent or guardian's consent. Consult a physician before beginning any fitness program. WorkoutMate offers guidance and motivation but does not provide medical advice or guarantee specific outcomes.

3. Accounts and Security
Provide accurate information, keep your login credentials secure, and promptly notify us of any unauthorized use. You are responsible for activity that occurs under your account.

4. Subscriptions and Payments
Pro subscriptions are billed through Stripe and renew each billing cycle until cancelled. Pricing for Pro is currently $5/month and may change with notice. Applicable taxes may be added. You can cancel anytime; access continues through the current period. Refunds may be provided where required by law or at our discretion.

5. Acceptable Use
Use the Service only for personal, lawful fitness purposes. Do not reverse engineer, misuse, disrupt, or use the Service to harass or harm others. Do not upload content you do not have rights to or that violates others' privacy or intellectual property.

6. Content and Data
You retain ownership of workouts, progress photos, comments, and other content you submit. You grant WorkoutMate a limited license to use that content to operate, improve, and display the Service. We may remove content that violates these Terms.

7. AI and Safety Notice
Form analysis is automated and may not detect every issue. Always use proper equipment, maintain awareness of your surroundings, and stop if you experience pain. WorkoutMate is provided "as is" without medical guarantees.

8. Privacy
Your use of the Service is subject to our Privacy Policy at https://workoutmate.top/privacy-policy.

9. Termination
We may suspend or terminate access for misuse, non-payment, or risk to the Service. You may stop using the Service at any time. Provisions that by nature should survive termination (including ownership, payment obligations, disclaimers, and limitations of liability) will continue.

10. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, WorkoutMate is not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim is limited to the amount you paid to WorkoutMate in the 12 months preceding the claim.

11. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California for disputes arising out of these Terms.
